Pjiang and xiaobaito, please help! H-4 problems, urgent!

My son's H-4 extension (I-539) was submitted concurrently with my H-1B extension (I-129) under premium processing service. My son's petition has been returned because of improperly signed (we did not sign in part5 and 6, but I signed in part 7). My son is 6 years old, does he need to sign in part 5 of I-539 if I check the second option in this part(each and every question...).I plan to resubmit his I-539, but his I-94 will be expired after sept. 15, 2009. Can he tays here if the application is still pending?
