Currently,i only have H-1B approved paper and I485 pending.i applied for AP in 2007 and used AP to enter USA in June 2008.So, my I-94 card was writen June 2009 expiration. Then I extend my H-1B in USA in Sept. In a word, i have no valid I-94 card so far. i will go to Canada for landing and am sure to come back in one week. Do you think i am ok?
-I think you are OK. The I-94 for AOS does not expire until your I-485 approval/denial even if your parolee status expired in June 2009, so you just bring the I-485 receipt and the I-94 (got with AP) with you and show them to the Immigration officer when you reenter to U.S. from Canada. Explain it to the officer that your status is AOS if necessary.
