回複：一個關於AP180天的問題

請教一下，我是485pending(跟隨丈夫一起遞交的)。我兩年前畢業，沒有申請OPT，現在也沒有工作（但申請了EAD）。最近申請了AP。請問在從中國回到美國時用ＡＰ會不會有問題？
-You did not tell us when you filed the I-485 after you graduated, nobody can answer your question correctly.

我問這個問題是因為今天485麵試，local的officer警告說如果在美國沒有合法身份180天之後，用AP可能海關會不讓放行。在此想請教過來人，這種情況下用AP會有問題嗎？
-It is true if you were unlawyful presence > 180 days before you filed your I-485. Also, you can not get your green card either in this case unless you married a U.S. citizen.
