I received an employment based I-140 request for evidence about ability to pay. The company failed to response timely. Now I want to reopen this I-140. What should I to USCIS? Here is my list.
1. I-290B
2. Company annual report 04-09
3. My W-2 and pay stubs from 04-09

Is there something I missed or I should be aware of?
-If the I-140 was sponsored by the company (i.e. PERM, tehn I-140), you have to ask the company to file the I-140 Motion-to-reopen. You have no right to do that. Also, "Ability to Pay" is a very serious issue, so you may contact your employer and the lawyer to prepare the paperwork carefully.
