NSC EB1A RFE (7/15 PP, 7/24 RFE FAX notice)

References: 8 (US 7, France 1; 2 independent references; 5 of them are from Chinese)

RFE details:

The evidence you have ted does not establish eligibility for this very restrictive visa classification. You must submit additional evidence that demonstrates that you have garnered sustained national or international acclaim and that your achievements have been recognized as extraordinary by others in the field. Extraordinary ability is defined as “a level of expertise indicating that the individual is one of the small percentage who have risen to the very top of the field of endeavor.” Title 8, code for federal regulations section 204, 5(h)(3) describes the types of evidence that may be submitted to establish eligibility under this classification.
The record indicates that you submitted evidence relating to the following criteria: I, II, III, iv, v, vi, and viii.

i) The record contains evidence that you received the XXX scholarship, a grant for your XXX proposal, and that you supervised a winner of US Stockholm Junior water prize.
Please submit documentary evidence of any additional awards received, along with documentary evidence which establishes the eligibility and criteria for winning the award or prize. Also submit documentary evidence to establish the reputation of the organization granting the award and any other documentary evidence to establish the significance of the award or prize.

ii) The record contains evidence establishing that you are a member of Sigma Xi, XXX, and AAAS.

Please submit the section of the constitution or bylaws which states the membership criteria.

iii) The record contains evidence that your work has been cited.
Please note: to meet this criterion, among other requirements, the article must be primarily about you and your work. Any articles that briefly cite your work will be considered under the “authorship” criterion below. Please submit any published material about you in professional or major trade publications or other major media, relating to your work in the field. Please submit documentary evidence to establish the significance of the publication in which the article appears.

iv) the record contains evidence that you have served as an editor of the electronic journal of biology, and reviewed manuscripts for other publications.
Please submit documentation of the criteria for selection as an editor and reviewer.

v) The record contains statements attesting to your original contributions.
Please submit objective documentary evidence of your contributions and the significance of each contribution to the field.

vi) the record contains copies of your scholarly articles.
Please submit copies of any additional published articles by other researchers citing or otherwisely recognizing your research and/or contributions. (citing articles may have been published after the filing date) please highlight the portion of the paper that references your work and highlight your name in the bibliography or “works cited” section. Please also provide a translation for any foreign language documents. It is not necessary to submit the entire article; however, you should provide at least the title page and the relevant pages which include the citation, as well as the entire references section. In the alternative, you may also submit printouts of search results from such websites as scifinder and google scholar, just to name two. Please note that any such printout must contain the title, authors, and publication information for both the cited and citing article. Search results that do not contain such details will not be considered evidence.

vii) this creterion does not apply to your field of endeavor.

viii) the record contains evidence of your work with the XX institute at XXX University. Please submit documentary evidence to establish how your performance is/was extraordinary relative to others in parallel positions or more senior positions in the organization.

ix) The record contains your 2007 and 2008 income tax return…..

x) This criterion does not apply to your field of endeavor.

Finally, the regulations allow for the submission of comparable evidence if the above standards do not readily apply to your occupation. However, for any such comparable evidence to be considered, it must be established that the above criteria are not applicable to your field of endeavor. It is also noted that the mere submission of evidence relating to three or more of the above items may not establish eligibility for this classification. As previously mentioned, the evidence must demonstrate that you have garnered sustained national or international acclaim and that you achievements have been recognized as extraordinary by others in the field.

請了律師,溝通和服務都算很職業。claim了7條。第8條律師附上稅表並沒想claim,因為生物postdog的工資高也高不到哪裏去,而且我的並不高。
當天知道消息後,自是非常鬱悶,畢竟準備EB1A到投寄,已經是絞盡腦汁精疲力盡了。一開始覺得毫無辦法,後來再靜下心來仔細讀RFE,及到處收集的RFE做參考,感覺有一下幾點教訓和體會,也許不盡然,願意與各位同道及綠大俠們分享學習:
1) 首先,不應該claim那些比較勉強的項目。現在看來,多而不強還不如少而精。有一些同道認為claim多了反而有負麵的影響,更容易被RFE;
2)我打算隻側重3-4點,看能否在挖些紙麵的證據;
3)推薦信我認為中國人的太多,而且有2副教授。。想再找幾個推薦信,雖然很難。大家認為會有用否?
4)其他的幾點,盡可能地象對待文章審稿人的意見那樣,逐條回答(雖然目前還不知如何做)。

最近因為這RFE,工作和生活都有影響,明知這樣不好,可有能如何?本不是很想留待美國,隻是既然花錢請律師做了,那就盡最大的努力了。

各位還在RFE的,已經RFE並通過了的,和早就拿到卡的xdjm,非常願意得到你們的想法分享,建設性的意見,或是 RFE模板、消息分享。同樣,我也會常常更新我的帖子,分析我的一些收獲。
