我的情況：今年1月20號被解雇，2月20號提交了H1B transfer， 申請中注明了計劃3月16號開始新工作，種種原因現在還沒上班，H1B transfer也還沒批下來。原I-94今年9月30到期。我的問題是：
1。在H1B transfer 批下來前，我是否可以一直不用上班？

2。我的H1B transfer 算是 timely filed 嗎？
_technically, no. But practically, you are fine because only one month from you were laid off to you filed the transfer may not have any negative effect on your H1 transfer.
如果我的申請被拒絕，Unlawful presence 是從1月20算起，還是從被拒絕的那天算起？
-You will be counted out of status from the date of the transfer denial, but your unlawful presence will be counted from the date of old I-94 expiration (Sept. 30).
