2. 有AP, (H4) I-94 失效(>180days), 要不要交I-94?
因為有I485 pending, 在US境內仍是合法.但領事館或邊境是否會認為已非法滯留? 主要想出境簽回H4.
-Your current status is AOS, not H4/H1, so you can not get an H4 visa. If you do that, your I-485 may be affected.

I do not think you need to get an H4 status now. You can use AP for travel and use EAD to work. If your I-485 is denied, you can get an H4 visa in China to get h4 status at that time. So, as long as your spouse keep the H1 status valid, it is safe to you.
