Help on H4 going back to China

我的H4 visa stam到2005年5月到期，這也是i797的到期時間。問了老公公司的律師，我們11月份就要開始file extention. 我想明年1月底回去，3月底回來。律師說，隻要我拿到extention的receipt,我就可以走了，但無論什麽時候回來，我都要在中國重新申請簽證。老公和我都不理解，為什麽呢？我明明有valid visa stamp until next May. 我們理解隻要我在失效之前進美國，就應該沒事，對嗎？
