Hi,
I'm currently have I-485 pending over 180 days under EB-3, PD 3-23-06. I could qualify for EB-2 but current employer does not agree to refile. If I change employer, could I have the new employer files under EB-2 and still carryover the previous PD? I read online about this and it appears if the new I-140 got approved before the previous employer withdraw old I-140, I could do that. But would the new employer be able to file and received 1-140 approval in a short time I before I leave the previous employer? There's a expidited process for I-140 but I'm not sure if I would qualify. I currently have H1-B and it has been extended beyond 6 years.
Does anyone also know good immigration lawyers in NY I could contact with?
Any Advice would be greatly appreciated!
