If you want your I-485 to be approved based on this I-140, you need 受所謂的“工作性質相同或相近”的約束. using EAD or H1B doesn't change it. If you have other underlying immigrant petitions for the I-485 approval to be based on, you don't have to use this I-140 and therefore not 受所謂的“工作性質相同或相近”的約束.
