What makes you think that TN rejection has no record? I believe that it has record.

I was once rejected for TN because occupation and degree don't match. The next time I entered US for job interview, they won't allow me in, and asked my potential employer to supply a letter saying that they will sponsor H1B. Otherwise, they won't let me in for interview.
