1. many (and in fact most) people succeeded coming back this way, some without a problem all all, some had problem but still were let in after given a hard time, also heard a few failed cases where CBP actually enforce the law correctly.
2. supposed to be. but for those people who got back succssfully, most still got GC. However, it is a legitimate reason to deny.
