I feel this is a gray area, depending on many moving parts. The key point is whether the business constitutes an "employment" status for you. If you can defend you're not employed, then you should be OK. I have a friend owning a registered business with a H2 visa - didn't have an issue to get his green card.
So I intend to believe it should be fine if you own a business as a founder - set up the business in a way that you can earn profit/dividends but not paid by payroll. Just my 2 cents... better to consult a lawyer.
