我試著回答一下吧，如果有更專業的，歡迎指正。 你們如果file as a joint return, 你是不可以file as non-resident, you need to follow your wife's filing status as a resident. During the time when you were under OPT, your employer was not supposed to withhold any Social Security or medicare taxes. If they did, you can directly ask for a refund through your employer.

Once you file a joint return with your wife as a non-resident, you can not reverse that election in the next year, say you want to file as non-resident.

Since you guys are paying mortgage, generally speaking, you are better off filing as resident because you can itemize your deductions which include your mortgage interest payment.
