回複：請問H1轉H4問題，拜謝！

我LD的H1B今年6月份到期，找老板要簽字file extension時發現老板支支吾吾不肯簽，看來老板是要通過H1B到期來解除雇傭關係了。現在打算辦H4，有幾個問題懇請版上達人們解惑：

1. 如果到H1B過期的時候H4 file了但是還沒approve的話，這時候是不是必須回國？否則的話會不會有gap?

2. 申請H4的時候日期要填哪天?她的Extention後的日期還是我的current H1b到期的日期？
- Assumptions: 1) You're both in H-1b, and your spouse plans to COS to H-4 based on your H-1b.
Your spouse should file I-539 prior to his H-1b expiration.

3. 如果H1B沒有extension，回頭從H4轉H1還要subject to cap麽？
