Just go ahead to do what I suggested. Based on 245 (k), if you get a new visa to come back to U.S, your previous unlawful presence will not counted, and your I-485 will not be affected. Sometimes some of lawyers can make a mistake to instruct you because too many immigration laws and regulations are changed from time to time, and one person can not be familiar to all of these policies.
