必須出境申請新的I-94嗎？

我的律師給我申請H1B時居然沒有按"Change of Status",因為我的舊TN過期日和H1B生效日的gap....所以我的H1B沒有I-94。

這種情況下，我必須出境申請新的I-94嗎？入境有風險嗎？
