You can change your status to H4 any time before your TN I-94 expires if your boss does not tell your unemployement to USCIS. As long as your boss has not informed USCIS you were laid off, nobody cares about this thing. Unlike H1, H4 application does not need to provide paycheck stub. So, do not worry about that.
