I think there should not be any problem for you to get TN visa. One attorney told me that. But you have to be careful about your answer to the question why you want to transfer H1-B to TN. Do not mention that your employer does not support your H1-B transfer. You can tell them that TN is more convient for you now since it can have up to three years now as H1-B.

Another way is that you told your employer that you will ask your own attorney to transfer H1-B for you. The company does not need to pay anything. You will pay all the fee yourself. THe only thing you need the company to do is documentation support. I think usually a company can do that.
