Alternate Chargeability,皮匠大師

Concurrently filed I485 is pending (R.D: June, 5 2007).
I140 NIW (P.D. May 11, 2007; approved on Sep, 29, 2008)
Claim: Alternate Chargeability when file I485. Fingerprinting has been done and NC has been gone through (infopass).
Update: Senator made an inquire on I485 showing no visa number available.
In Fact: Category II is always available (Current) for my spouse
Possible problems: The office did not notice the Alternate Chargeability.

Questions:
1. Can we call it a“concurrently filed 485”as there was a little gap ( Lawyer did I140, I did I485, but had to wait for the receipt notice of I140)?
2. How could we solve this problem?
A. Duplicate I485
B. Writing a letter to the local director (TX)?
C. Ask for help from the senator
D. WOM
