Issue about F1 used EAD got caught--does that violate the immigr

To dear teacher Pjiang and other experts,
Your articles are very helpful. Thank you. Could you pls check the following case?

Backgroud: F1 with 485 pending, file 140/485 July 2007. 140 still pending.
After got the 485 and 140 receipts, didn't go back to school to attend classes and used EAD
card to work. I-20 still valid till the year of 2011.
Got caught in Oct 08 when travling in the NYS by taking the greyhound bus and waiting for hearing in Buffalo.

The reason is said that this F-1 still active in SEVIC system because
school didn't cancel it, so this student failing to attend classes and violate that" F-1 can't work"

I don't think there is out of status problem because before filing 485 still in good status and anyone got EAD under filing 485 is allowed to work, right? How do you think? Pls help.
