本人持H-1B，EB2，485 遞交已過180天，同時持EAD, 我女兒的I-94 為09年1月19日到期，本月突然失去工作，如果我在11月內找到工作，轉換H-1B 的話， 請問女兒是否要在1月19日前換I-94?

If your daughter is in H-4 and the I-94 will expire on 1/19/2009, further if you want to keep her in H-4 status after that date, you must file H-4 extention and get a new I-94 for her based on your new H-1b. Otherwise she will lose her authorized stay as H-4 dependent.


我的新公司要求我現在急需回中國出差，時間為5個月，請問我是否可以在EFILE TRANSFER H-1B後即回中國？待收到正式批準書後， 讓公司寄給我？還是我一定要等到有收據號後才能回國？還是一定要等到收到正式文本後才能回國？

If the transfer is not approved during the time when you stay in China, you will have trouble to get back as H-1b worker. Further, since you are not in H-1 status while your transfer petition is pending, your I-485 is deemed to have been abandoned when you leave this country unless you have approved AP. To reduce the risk, I suggest you to have the transfer approved before leaving this country.
