Is it legal to keep H1B without being paid?

Dear all,

My H1B on the 797A form is valid till Dec. 31, 2008. I notified my boss that I will leave in Nov, and just found that he stopped my payment on Oct. 31. 請問有沒有不拿工資但是讓老板把雇傭時間放在11月30日的可能性？這樣做對老板來說會不會違法？我現在在學校做博士後，準備回國工作，由於現在準備時間特別緊張，很想在11月再待兩周左右，但擔心下次過來開會之類的簽證會因為非法滯留1至兩周而受到影響。請大家給出建議。
