No. Your current status will 09年1月9號過期, so you need to file h1 extension to a new date of period (e.g. 1/8/2012) and get it approved, and then you can get an H1 visa outside U.S. if you leave U.S. Thus, your status will be from 1/9/09 to 1/8/2012. If you get a H1 visa outside U.S. now, your H1 status still will be valid only from now to 09年1月9號.
