3. it takes a few days for lawyer to prepare your case-if they prioritize your case

4. it is very unlike to force USCIS to adjudicate your case within this month -- USCIS is required to response within 60 days, and it is hard to argue visa once your PD become unavailable, but very likely that USCIS will hold your case and adjudicate your case quickly once your PD current. Remember, if USCIS response your WOM with MTD (motion to dismiss) because of the visa issue, it will cost about $5000 for lawyer to prepare the response
