Most people get EAD within 120 days. But I understand there will always be some unlucky ones.
If your company HR look at the latest version (Nov 2007) of m-274 (I-9 manual) they will see that company will not be punished to keep you on payroll if your I-765 has been pending for 90 days or more. Company is off the hook, but you are still accruing illegal days to the 180 days for 245k purpose if you continue to work.
