(1)-Who tell you about that? Usually your H-4 renewal application will be approved in several months. Just file the extension and nothing to worry about.


The process time on this kind of case in Vermont is about 11 months, Before I came back China, I applied H4 renew and it took me 10 months and at that time, the process time post on the web is 8 months.

(2) Yes, as long as your hu*****and I-1485 Priority Date is current.

My I-94 expired date, also is my H4 Visa expired date, in Oct. 8. We will submit I-485 on Nov., at that time, my current H4 Visa and I-94 will expire, only left my H4 renew application pending. I am wondering if I can submit I485 on Nov. It seems to me on Nov. I will be out of status, only legal stay. Am I right? Thanks.
