I wonder if anyone has experience using a valid H-1B visa stamp after
changing job? Here is my case:
PD: 02/2006, I-140 approved, I-485 pending for more than a year.
Got a valid H-1B visa stamp at Toronto December 2007. Since I am a Canadian
PR, the expiration date for this H-1B visa stamp on my passport is the same
as H-1B (03/2010).Since I worked for Company A while I applied for the visa
stamp, the petitioner on the stamp is Company A and the case number for the
H-1B application filed by company A is also on the stamp. I changed my job
to Company B this August. The H-1B transfer is already approved. I am going
back to China for two months and I decide to use this H-1B visa stamp to
come back. My lawyer told me I can still use this visa stamp (just bring
the last two pay stubs from Company A and pay stubs from company B, as well
as the H-1B approval notice).
One of my concerns is that it is company A policy (I believe most company)
to report to USCIS after I changed my job. The status for my approved H-1B
application filed by Company A is changed to "reopen".
I wonder if anyone here has experience using H-1B visa stamp similar to my
case? Any information is highly appreciated.
