請問H1 workingpermit 12/30/08 過期，12/5/08 反簽有沒有問題啊

我的H1 working permit12月30號過期，7/1 filed H1-renew，receive-notice也收到了。我10月初要回中國一次，12月5回來。如果到時還沒有收到approval-notice的話，反簽會不會有問題啊？壇子上有沒有TXJM有similar case的阿？
