懇請Pijang 老師再幫助2nd 485 REF:

首先非常感謝Pijang 老師回答我8-22 貼的有關我的485 （1st NIW case） 的REF 的棘手問題。 我會根據你的重要建議來回複USCIS的2ND REF of the 485 ("please 遞交 proof of your continuous employment authorization in the U.S. from may 31, 2007, to the present, "or" in the alternative, evidence to establish that you have not been employed in the U.S. without authorization"). 但懇請您再幫忙來陳清兩個問題：

1) 在遞交材料時，H1 B 應該是一定要交的（因我從12/2006 到現在一直用H1B 工作的， 5/2008 用AP 回過國， 回來後AP 與護照上寫了AOS）。 我是否也需將今年基於我去年DIY 140/485 （2nd case） 申請到的EAD一起遞上，然後在COVER LETTER 上強調我一直在給我申請H1B的該單位工作， 從未用過EAD 工作？

2）你有EAD， 但移民官可能很難判斷你是否用過EAD。因此，除了在COVER LETTER 上寫上“我從沒用過EAD”是否 還需要其他證據來說服移民官你是一隻用H1B 工作的？

3）如果2）的答案是：那馬從學校開一證明說明我沒用EAD 而是一直用的H1B工作是否可以？

p.s. I have applied 2nd 140 （DIY） in last July. I have used 1st 485 and 2nd 485 to apply EAD in 2005 and 2008, respectively. But I never used them to work. I have used AP (based on 2nd DIY-485) to travel. Current 2nd REF is for 1st 485 (NIW).
