Pjiang & xdjm, please help me answer this last question on I-129

On the "H-1B Data Collection and Filing Fee Exemption Supplement"

Part A. General Information.
1.Employer Information - (check all items that apply)

c.Is the beneficiary an exempt H-1B nonimmigrant?
1. If yes, is it because the beneficiary's annual rate of pay is equal to at least $60,000?
2. Or is it because the beneficiary has a master's or higher degree in a speciality related to the employment?

Here is my question: Can I answer YES to both 1 & 2 because both are true for me, or I just asnwere YES to 2 & NO to 1? Because either YES to 1 or 2 will make the answer to (c) being YES.
