out of status?

我四月底被layoff，律師建議我馬上 file B1 旅遊簽證，理由就是需要時間賣車賣房子，layoff之後兩天file的B1，一直等消息，同時找工作，七月初拿到一個offer，律師準備withdraw B1 申請H1 premium process，file H1 的當天接到移民局的信說B1被拒，理由是有移民傾向，今天有收到移民局的信，H1已經approve,但是要回中國簽證，我這種情況是不是算out of status？我回國簽有沒有可能因為out of status被拒?我是相信律師的話才file的B1，等了兩個月才被通知denied，這中間我算out of status嗎？
