it depends on what the AUSA said in the MTD and your response, if your court's history show that it has jurisdiction and now the only issue for your case is PD, then you can just file something " complementary to your response ....", explain to them that your PD will become current.

also contact AUSA at the begining of next month, let him/her know that your PD is current, so he/she can push USCIS to adjudicate your case, instead of fight in the court
