It is illegal for you company not to file tax return. So they have tax return, but comapny has every right not to provide their tax return, and thus kill your I-140 chance. USCIS memo lists three types of documents acceptable for evidence for ability to pay, your lawyer knows how to respond.. This is a common RFE for small employer, and your lawyer should have explained all this to company and you before filing PERM.
