If as you said I get H1 apporved with 797B. Can I wait in US with H4 till closer to the visa interview date, so the period I am outside US is only ~1-2 week? (assuming I don't get checked or something.)

I am in fact expecting a denial of my hu*****and's I140. I am trying to weigh whether to apply H1-b directly ASAP or get an H4 ASAP and apply H1 after we get the notice.

It sounded from your points, my chances of going outside US to get stamp would be the same, AOS to H1 or H4 to H1, right?

Any suggestions? I am not sure if the company will keep my position if I have to be out of work for 1-2 month. If I am in US, I can volunteer to keep the project going without pay.
