The company with financial difficulties may still sponsor a green card in some situations, such as the company is a start-up or has temporary financial difficulties due to the current market condition. The bottom line is the company must be a bona fide business with a real business need.

If an employer gave the USCIS or DOL a mistatement of its financial conditions with an intent to defraud the government, the employer may be liable for civil or criminal penalties. Unless the employee is involved in the fraud, he or she should not be liable.
