My H-1 will expire in December 2008, but I returned to the US in November 2007 by using AP. I have changed the location of my employment since January, but with the same employer. My employer wants to file an amendment to my H-1B application to reflect the change of location, but my immigration attorney said that I would have to obtain a new H-1B visa stamp first, therefore reinstating to H-1B status before filing an amendment of my H-1B. Is my lawyer correct?
