What the lawyer said is correct. If your hu*****and still keeps his valid H1, you will be fine because your H4 is valid, which is your legal status. You can apply for your green cards again. It does not mean that you will lose your H4 once you use your EAD. You should stop working when you know your hu*****and's I140 is denied.
