I have asked you the question before but I think I didn't make my question clear.
My hu*****and is in USA with mutilple entries H-4 visa. Exipy date is Aug. 31. He plans to go back China in May. My company is applying H-1/H-4 visa for us for 3 years extension. My company lawyer said that when my hu*****and comes back, he should use the approval notice which expiry date will be Aug 2011. The airport immigration officer should give him a new I-94 with new expiry date Aug 2011, not old H-4 expiry date Aug 2008. Is this correct?
My hu*****and insists that the lawyer is wrong (she made a lot of mistakes before). My hu*****and said that if he uses the new H-4 approval notice, he has to apply visa in China before he comes back US. He said the new H-4 approval is a status, not a valid visa. So he couldn't use it to re-entry USA. He said after he comes back USA, he still needs to re-apply H-4 extension because the # in Approval notice is different from his new I-94 (still keep the old visa #).
Could you please help me who is correct? Thanks a lot ASAP
