向皮匠 及各位專家請教H1B transfer.

I am working as Postdoc in a University with H1B visa (non-profit type). In 2007, I submitted I-485 based on approved NIW, and got EAD card. Now I got an offer from a company with a starting date April 1st, 2008. Obviously I can work for the company using my EAD card, however, I would like to apply a H1B (profit type) visa (or H1B transfer).

I have two questions on the H1B transfer. First, I know the effective starting date for new H1B is October 1, 2008. So can I work for this company during the period April 1 to Oct.1, 2008?

Second, I heard there is rule that once your new H1B application got approved before Oct.1 (for example at July, 1), then you cannot work for the new company during the period from July 1 to Oct.1. Is this H1B portability rule true or not?

In addition, if I used EAD. What the status of my son will be ( current with H4)?
