4月1號industry H1B申請，律師非要申請straight h1b，要求十月1號離境。請分析

我現在是大學H1B VISA(第三年)，WILL EXPIRE IN JULY 2008. 明天學校遞交h1b延期申請(extended through october 1st 2008). 同時公司正在申請占GAP的H1B，準備3月31號遞交。

公司律師擔心我七月到十月之間有GAP，而且從明天FILE H1B EXTENSION 算起，不可能在四月1號前拿到 RECIEPT,因此要為我申請STRAIGHT H1B， 就是說INDUSTRY H1B APPROVED 後 我要離開美國 TO ACTIVATE INDUSTRY H1B。

請教大家

(1) What is straight H1B?

(2) In what conditions, I do not have to depart U.S?

(3) My university h1b extension will be filed tomorrow. university would like to provide evidence, (offer letter, FEDEX tracking record, letter certifying that i have filed h1b extension petition), but lawyer said these wont work? Any suggestions?
