first application filed 6monthes prior the expiration date. (圖)

VSC returned our application 3 times during June to August 2007 to ask a valid LCA but those 3 notice of return didn't mention the LCA is the form ETA9035. we called VSC and Department of Labor to ask help. One lady answering our phone whom we believed in charge of 7th year certification at Department of Labor told us use the ETA750 to meet the requirement of VSC. We submitted our file fourth time in Sep. with ETA750, (we had realized that was a big mistake until we received a denial decision on Jan 25, 2008) and VSC issued a receipt notice this time in Sep. 2007. We got a Letter ON DEC. 2007 TO ASK A VALID LCA(ETA9035) THAT MUST BE CERTIFICATED PRIOR THE FILING DATE ON 0X SEPEMBER 2007. (AT THIS MOMENT THERE IS NO WAY FOR US TO GET THE LCA THAT IO ASKED. THE LCA WE GOT NEXT DAY ON DEC. 26 2007 WAS CERTIFICATED DEC. 26, 2007-DEC. 2010. (IT IS CLEARLY INDICATED THAT LCA IS FORM ETA9035 BY THIS LETTER) WE SHIPPED THE LAC TO VSC A WEEK LATER AND A DENIAL LETTER CAME ON JANUARY 25, 2008. WE APPEALLED A WEEK LATER AND PAYED $585.00. I GOT A LOT HELP AT THIS FORUM FROM PJING, BAITU AND OTHERS. THANKS FOR THEIR GENEROUS HELP. WE SUBMIIIED 7TH-9TH YRS EXETENSION WITH PREMIUM PROCESSING SECOND TIME ON FEB 2008. USCIS ASKED 補件 ON FEB. 26, 2008 BY FAX, WE FAXED BACK OUR APPEAL DOCUMENTS AND MY COMPANY CHAIRMAN'S LETTER ASKING TO ISSUE I94 FOR ME & MY WIFE ON THE SAME DAY. WE GOT DENIAL DECISION AGAIN WITH THE SAME REASON BUT USCIS ISSUED A NEW H1B STATUS THAT VALID UNTIL DEC. 2010 ON MARCH 3RD, 2008. WE WERE SURPRISED BY THE RESULT. IT SEEMS IT IS WORTH TO PAY $1000.00+320.00 +585.00 FOR THIS RESULT.
