This office is unable to complete the processing of your petition without further information. Please read and comply with the request below and then submit the evidence to above address. Include a copy of this letter and place the attached gold sheet on top of your documents.

The petitioner has filed form I-140 for classification under Section 203(b)(2)(B)(i) of the Immigration and Nationality Act as a member of the professions with an advanced degree or an petitioner of exceptional ability. In addition, the petitioner is requesting that the job offer and the correlating labor certification from the Department of Labor be waived in the national interest.

A recent precedent decision, Matter of New York State Dept of Transportation, enumerates factors that must be considered when evaluation a request for a national interest waiver. See Matter of New York State Dept. of Transportation ID 3363(Act. Assoc.,Programs, August 7,1998). First, ti must be shown that the petitioner seeks employment in an area of substantial intrinsic merit. Nest, it must be shown that the proposed benefit will be national in scope. Ther final threshold is that it must be persuasively demonstrated that the national interest would be adversely affected if a labor certification were required for the petitioners.

The labor certification process exists because protection the job opportunities of U.S. workers is in the national interest. The petitioner must establish that the petitioner will serve the national interest to a substantially greater degree than would and available US worker having the same minimum qualifications. Because the labor certification process is already in place to address labor shortages, the national interest waiver is not to be based on ameliorating a local labor shortage.


Please submit an evaluation of the beneficiary’s education equating the beneficiary’s education to that of an accredited United States college or university in accordance with the applicable regulations. The evaluation must be by a reliable credentials evaluation service, which specializes in evaluating foreign education credentials, or by an official who has authority to grant college-level credit

Please submit documentary evidence of the exact influence as an individual that the petitioner’s work has had on his specialty or on the field in general.

Please submit documentary evidence of the beneficiary’s individual specific contributions made in his field. Are these discoveries and contributions being applied and used? Provide documentation to support your claim

If the petitioner’s research results have been cited by others in this field, submit citation indices, showing number of citations and titles of articles in which the petitioner’s works were cited.

All research appears to have been conducted as a member of a team and the beneficiary is not the lead. The beneficiary’s role in the research projects needs to be clarified. Please describe specifically all of this petitioner’s exact individual prior achievements and how these have influenced his field.

How does the petitioner’s work compare to others in this field? Have experts (other than other members of the beneficiary’s research groups, beneficiary’s University research teams and beneficiary’s collaborators) in this field recognized the petitioner’s work? How do the petitioner’s publications separate him from others in the field? Submit documentary evidence in support of your response.

Any additional evidence submitted will be considered in conjunction with the current record to determine the petitioner’s eligibility for this classification.
