The O-1 visa is often used to employ foreign nationals who hold J-1 status and who are subject to the 2-year home country residence requirement. It may also be used instead of the H1B visa if the foreign national has exhausted all time on the H-1B visa or will not qualify for the H1B visa, due to testing requirements for International Medical Graduates (IMGs), for example. J-1 visa holders who are subject to the 2-year home country residence requirement will NOT be able to change their immigration status within the U.S. We will submit a petition for an O-1 visa to the USCIS and, if the petition is approved, the J-1 visa holder then must leave the U.S. and apply for an O-1 visa at a U.S. consulate or embassy overseas (Canada or Mexico may be an option). Return transportation costs to the country of last residence must be paid by the sponsoring department if the foreign national is terminated before the O-1 visa status expires. The foreign national may only work at Emory University if Emory University sponsors the O-1 visa. The O-1 petition may be filed up to six (6) months prior to the employment start date. An individual may enter the U.S. with an O-1 visa 10 days prior to the start date of the approved petition, but he/she may not begin work until the effective date of the petition.
