I am planning on using AP this year, but my attorney said this:
"If you enter in AP status, you are no longer in H-1B status. You can apply for H-1B in the future (without worry about the quota) and/or use your approval notice to get an H-1B visa. If you are going to enter in AP status, you will also need employment authorization in order to continue working.", which conflicts with what I read from a lot of posts here. Anyone think my attorney is correct? Or does anyone have experience renewed/stamped H1B after using AP? I just want to make sure I have H1B even if my I-485 got denied.
