it is my understanding for filing 1040nr that 1040nr is uesd by nonresident alien, who lives in usa less than 183 days and without gc, or who is benifited from country tax treaty. otherwise, the 1040 should be filed. even if your i485 is pending the processing, it is still not sure if your i485 is approved. your filing i485 just indicates that you intend to be lawful permenant while when i485 is pending.
