you still need to put FBI on the list for reasons:
1. this memo is internal only, not public record, they can change back anytime
2. the memo does NOT eliminate the need of name check, only change the order of procedure, and FBI still response for name check, and involve in your application
3.easy to put FBI on the list and then remove from defendant list IF USCIS agree to take ALL responsibility, it is very hard to add defendant if USCIS deny the responsibility of name check
