1. Is it possible for USCIS to get a decision before my back?
IO may make a decision upon receipt of your RFE response.

2. If my petition is denied before my back, may I still re-enter USA with the current AP?

If unfortunately 140 is denied, since 485 will be denied accordingly, please get H1B stamp in advance. Permission for reentry will largely depends on port officer, as your AP is technically invalid. For this precaution, it's recommended to use valid H1 stamp for any 140 pending applicants.


3. Do I have to apply for a H-1 visa to prepare for the AP revocation?
