We received the denial notice of my H1b 7th yrs extension of stay on Jan. 27, 2008. My h1b 6th yrs expired on Nov. 1, 2007. We submit the appeal form I-290B on Feb. 9, 2008.
(1) should my employer supply my appeal information with my new I-129 7th extension of stay petition with PP? (to show that I maintain H1b legal status during the period from Nov. 1, 2007 to currnt date).
(2) if I have been out of h1b status from 11/01/2007 until now, what measures should my employer take to deal with those days with my new I-129 petition?
My wife's H4 extension of stay petition (the same expired date as mine) is pending, Receipt notice issued on OCT. 2007.
(2) Can my employer add her receipt of H4 extension of stay petition in my new file of I-129 petition in order to speed hers processing?
