The RFE requires:
(1) evidence that you have resided in your home country at least 2 years...
or
(2) you must submit an approval notice (Form I-797) issued by this Service to establish that you have applied for and been granted a waiver of the two year foreign residance requirement.
I think my first H-1B approval notice (I-797) can be used as the evidence. This because if you are subject to the "Rule", you can not get either H-1B or green card before you get the waiver.In my case, I just changed my J-1 to H-1B without any time break.
lklktg, my case is EB1 and is applied early last year with accelerated processing.
